A significant portion of the environmental litigation practice involves the defense of Potentially Responsible Parties (“PRP”) under the Comprehensive Environmental Response, Compensation and Liability Act (“CERCLA”), commonly known as Superfund. In a typical case, Mr. Maldonado will defend the PRP and negotiate with the Environmental Protection Agency (“EPA”) or Department of Environmental Conservation for an effective, cost efficient remedy. At the same time extensive efforts are made in these cases to bring other PRPs’ into the process and to identify insurance assets to assist in the paying of the cleanup costs.
Most recently, Mr. Maldonado has represented one of the largest private landlords in Long Island on a CERCLA matter. Through employing these tactics in litigation, Mr. Maldonado successfully saved his client in excess of $30,000,000 in cleanup costs. In addition, Mr. Maldonado has represented several fortune 500 companies in similar CERCLA litigation.
Mr. Maldonado has also represented several injured parties in Toxic Tort litigation. Multiple million-dollar settlements have been obtained in these cases compensating the injured parties for the personal injuries and property damage resulting from environmental contamination. These matters involved litigation against some of the largest companies in the country.
